Electronic Discovery Process
Trial Solutions can assist with any of the following E-Discovery
processes.
- Computer
Forensic Preservation, Collection & Analysis
- While ensuring that electronically stored data is protected
against destruction or alteration, we can gather electronically
stored data from various sources including tapes, hard drives,
portable storage devices, networks, cell phones, PDAs and
Blackberrys. Including Macintosh, Linux and AS400 operating
systems.
Preservation and collection usually overlap and can be
performed either onsite or remotely. A forensic copy (or
image) of the data is obtained. This image should be done
by a forensic expert, and in some jurisdictions it must
be done by a licensed private investigator.
- Culling & De-duplication - The process of reducing
the volume of electronically stored data using sorting and
filtering of various information such as source, file types,
dates, key words and concepts.
Each file is identified by a unique MD5 hash value and
given a production name. The hash value is used throughout
the process to provide an intelligent and defensible chain-of-custody.
- E-Discovery Processing - Converting electronically
stored information to various formats, such as native, Tiff,
PDF, HTML or XML, for review or production purposes.
First, Files are flattened into component parts. PST
and NSF are flattened into individual emails. Zip style
files are flattened into individual files. Microsoft files
are reviewed for embedded files, and these embeds are
flattened into individual files.
For each file discovered within another file an MD5 hash
is calculated. Parent / child relationship is recorded
using a very simple human readable decimal. File metadata
is extracted and recorded.

- author / last printed / last edit etc.
- dates and times
- fully searchable text
- Native Review & Analysis - Evaluating collected
electronically stored information (ESI) for relevance and
privilege, while determining relevant summary information,
such as key topics of the case, important people, specific
vocabulary and important individual documents. For more

Native file review leads to a significant reduction in
the number of relevant documents. Once these documents
are identified they can be tagged for production and further
review.
- Document Production - Delivering ESI to various
recipients such as a law firm or corporate legal department
for further use or ongoing management of the electronic
data. Production needs vary, therefore the output is flexible.
Production sets can be produced as any combination of
the following TIFF, JPEG, HTML, native or all of the above.
Production sets may also be Bates numbered and endorsed
according to custom specifications.
